Cullen hoback grew up on the outskirts of Los Angeles feeling trapped and out of place. When he was 17, he started his own public access late night TV show, but was kicked off the air after making a series of social statements that drew angry phone calls from locals. Trying to bring light to strange and unfamiliar topics became a common theme for Hoback. Throughout college he produced multiple short films, as well as a feature when digital cameras first became available. While at school, he studied English and theatre, butting heads with the head of the theater program when he wanted to mount “True West” for a one-week run instead of being in a play that season. He won that battle, but his grades suffered for it. When he was 21, Hoback responded to a Craigslist ad looking for a director of photography. After meeting with the producer, he was offered a budget and a chance to direct. He reworked the script, and in 7 days shot what would become the 55-minute FREEDOM STATE, a heartfelt comedy that follows a cast of misfits to the edge of the world. His other narrative feature is FRICTION, a film about people at a summer camp who play out a scripted tale as the line between fantasy and reality blurs. In 2007, he was given a small budget to direct the LARPing documentary MONSTER CAMP, which showed social outcasts banding together to create a community where magic is real, and identity is limited only by one's imagination. MONSTER CAMP received awards around the world, and was heralded by Variety as both "endearing and amusing." In 2011, Hoback was able to return to his forte of documentary filmmaking when he was given adequate resources to create TERMS AND CONDITIONS MAY APPLY. The film took two years to make, and Hoback had the luxury of working on just the film and little else. He's now looking forward to starting two new projects, as well as developing MONSTER CAMP into a TV show.

오늘도 20만 건. 매일매일 개인정보 유출 소식이 쏟아진다. 그러나 연초 카드사에서 벌어진 1억 400만 건 유출 기록이 경신되면 모를까, 이제는 뉴스가 되지 못한다. 개인정보 유출 소식을 듣고 당신은 어떠하셨는가. "보이스피싱, 걸려 오기만 해봐라" 개그프로에서 본 것 같은 어수룩한 사기꾼들에게 당하지는 않을 거라고 자신만만하시거나, "어차피 다 유출된 거, 뭐 어때?" 시니컬하고 쿨하게 넘어가시거나. 어느 쪽도 개인이 정신 똑바로 차리면 되는 문제로 여기는 듯하다.

그러나 우리들이 주목해서 봐야 할 사실은 이것이다. 왜 요새 개인정보 유출이 기승을 부릴까? 누군가 탐을 내기 때문이다. 해커이건 내부자건 그 정보들을 훔쳐내면 기꺼이 사줄 사람들이 있는 것이다. 국제적으로 번성해 있다는 개인정보 암시장에서 그들은 왜 당신의 개인정보를 돈 주고 사갈까? 사기를 치기 위해서? 그럴 수도 있다. 그러나 당신의 개인정보를 노리는 이들이 불법 시장에만 있는 것은 아니다. 오늘도 당신의 클릭을 기다리는 수많은 이용약관들이 모두 당신에게서 개인정보를 가져가겠노라는 내용들이다. 그들은 왜?

단언컨대, 당신을 지배하기 위해서이다. 물론 그들이 옛날 군주나 군인 독재자처럼 당신을 폭력으로 굴복시키는 것은 아니다. 그들은 소비의 늪으로 당신을 인도한다. 당신의 출신, 사회관계, 취향, 당신의 무엇이건 그들은 필요하다. 그 정보의 숲에서 당신이 이 물건을 사야 할 필요를 맞춤하게 발명할 수 있기 때문이다. 페이스북처럼 우리의 정보를 많이 가지고 있는 회사들은 이 정보들을 다른 이들에게 넘기기도 한다. 개인정보 합법시장의 등장이다.

당신에게 물건을 팔기 위해 당신 자신보다 더 많이 당신을 알고 있는 이들의 등장은 정보 인권에 위협적이다. 당신의 개인정보에 대한 결정권이 당신에게보다 권력에 주어졌기 때문이다. 당신에 대해 알고 싶어 하는 이들은 시장뿐만이 아니다. 신자유주의적 법과 질서를 수립하기 위해 당신이 무얼 생각하는지 궁금할 수밖에 없는 국가 권력 또한 그 정보가 필요하다. 물론 그들은 예전부터 당신을 알기 원했으나 인적 감시로는 한계가 있었다. 빅데이터 시대 감시는 촘촘한 기술이 대신해 준다. 그래서 그들은 당신의 사소한 좋아요 하나도 열렬하게 수집하는 것이다.

아직도 감시 문제에 대해서 본인이 떳떳하면 감수해도 되는 문제라고 생각하는 이들이 많은 것 같다. 그러나 감시는, 당장은 아니더라도, 언젠가 당신에게 영향력을 미치기 원하는 이들이 당신에 대한 개인정보를 촘촘하게 수집하는 상황을 말한다. 그러니 우리가 감시에 반대하는 이유는 숨길 것이 많아서가 아니다. 지배당하지 않기 위해서이다.

이 영화는 스노든의 폭로 이전에 만들어졌다. 지금은 간첩 혐의를 쓰고 러시아에 망명 중인 에드워드 스노든이 지난 해 6월 미 국가안보국이 전 세계 인터넷과 통신망을 도청하고 있다는 사실을 알리기 전에, 그들이 무슨 일을 벌이고 있는지 이 영화는 낌새를 알아챘다. 감독의 날카로운 문제의식을 믿고 볼 만 하다.
